These Terms and Conditions govern the use of the SCAPS website and online valuation services provided by Specialised Commercial and Plant Solutions (“SCAPS”). By accessing this website, submitting a valuation request, uploading information or documentation, or making payment for a valuation service, you agree to these Terms and Conditions.
2. Valuation Services
SCAPS provides desktop and, where separately arranged, on-site valuation services for plant, machinery, commercial equipment and related assets.
Online valuations are prepared using information supplied by the client together with SCAPS’s valuation methodology, calculation models, professional judgement and, where applicable, supporting market information.
Any automated calculation generated by the website is an internal calculation and does not constitute the final approved valuation. The final valuation remains subject to review, verification and approval by SCAPS.
3. Information Supplied by the Client
The client is responsible for ensuring that all information submitted to SCAPS is accurate, complete and current. This may include:
- client and company information;
- contact information;
- asset descriptions;
- make, model and serial numbers;
- year model and operating hours;
- original purchase price and purchase date;
- invoices and supporting documents;
- photographs;
- identification and hour-meter photographs;
- attachments and extras;
- insurance-related information; and
- any other information reasonably required to complete the valuation.
SCAPS is entitled to rely on information supplied by the client unless there is a reasonable basis to question its accuracy. The client must promptly advise SCAPS if any information supplied is incorrect or changes materially.
4. Authority to Submit Information
By submitting information, photographs or documents, the person completing the form confirms that they are authorised to provide that information to SCAPS. Where information relates to another person, business, asset owner, insured party or other third party, the person submitting the information confirms that they have the necessary authority or permission to provide it for the requested valuation or insurance-related purpose.
5. Insurance and Third-Party Disclosure
Where a valuation is requested for an insurance-related purpose, or where disclosure is reasonably necessary to complete the requested service, the client authorises SCAPS to provide relevant information, documents, photographs, valuation findings and reports to appropriate third parties.
These parties may include:
- insurance companies;
- underwriting managers;
- insurance brokers;
- assessors;
- loss adjusters;
- claims administrators;
- asset owners;
- finance providers;
- auditors;
- professional advisers; and
- other parties reasonably involved in the valuation, insurance or claims process.
SCAPS will only disclose information that is reasonably relevant to the purpose for which the valuation was requested, or where disclosure is otherwise authorised or required by law.
6. Insurance Decisions
SCAPS is an independent valuation service provider and does not control decisions made by insurers, underwriting managers, brokers or other third parties.
A valuation provided by SCAPS does not guarantee:
- acceptance of an insurance application;
- acceptance or settlement of a claim;
- the amount an insurer may settle;
- finance approval;
- a particular selling price; or
- that a third party will accept the valuation without further investigation.
Any insurance policy, claim or settlement decision remains subject to the relevant insurer’s policy terms, underwriting requirements and decision-making processes.
7. Valuation Estimates and Professional Judgement
Market values are professional opinions based on the information and circumstances available at the valuation date. Actual market conditions, asset condition, usage, location, maintenance history, supply and demand, economic conditions and other factors may affect the value of an asset.
8. Desktop Valuations
Unless an on-site inspection has specifically been arranged, an online valuation is a desktop valuation based primarily on information, photographs and documents supplied to SCAPS.
SCAPS cannot be held responsible for defects, damage, modifications, missing components or other conditions that were not disclosed or reasonably visible from the information supplied. SCAPS may recommend an on-site inspection where additional verification is required.
9. Fees and Payment
Valuation fees displayed on the website are payable before the valuation is finalised unless otherwise agreed in writing. Any applicable VAT will be added to the stated fee. Submission of a form does not constitute confirmation that payment has been received. SCAPS may place a valuation request on hold until payment has been verified.
Additional services, on-site inspections, travel, accommodation or work outside the standard online valuation scope may be quoted separately.
10. Uploaded Files
The client grants SCAPS permission to receive, store, reproduce and use uploaded photographs and documents to the extent reasonably necessary to:
- perform the valuation;
- verify information;
- prepare reports;
- maintain valuation records;
- communicate with the client;
- communicate with authorised insurance or related parties; and
- comply with legal or regulatory obligations.
Ownership of the client’s original documents and photographs remains with the relevant owner.
11. Limitation of Liability
To the extent permitted by South African law, SCAPS will not be liable for indirect, consequential or financial loss arising from:
- inaccurate or incomplete information supplied by the client;
- information deliberately withheld from SCAPS;
- undisclosed damage or defects;
- changes in market conditions following the valuation date;
- decisions made independently by insurers or other third parties; or
- use of a valuation for a purpose materially different from the purpose originally disclosed to SCAPS.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
12. Website Availability
SCAPS does not guarantee uninterrupted availability of the website, calculator, uploads, payment facilities or other online services. SCAPS may modify, suspend or update the online valuation system where necessary.
13. Intellectual Property
Website content, valuation methodologies, reports, layouts, calculations, branding and other materials created by SCAPS remain the intellectual property of SCAPS or their respective owners, except for information and material supplied by the client.
A valuation report may be used for the purpose for which it was issued but may not be altered or presented in a misleading manner.
14. Privacy
Personal and business information submitted through this website will be processed in accordance with the SCAPS Privacy Policy and applicable South African data-protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
